Xiaomi again denied a lawsuit against Ukrainian distributor NIS

After the return of one claim due to non-payment of the court fee, Xiaomi HK Ltd almost immediately filed a new application to the NIS distributor and demanded the arrest of a batch of 100 Xiaomi Redmi 4 2 / 16GB smartphones at the customs. However, here the company was waiting for failure.

What happened?

Economic Court of the Kiev region denied Xiaomi in satisfaction of the claim and did not recognize the party NIS counterfeit. The main reason - the company could not prove its rights to the trademarks Xiaomi, Mi and RedMi. Their owner is Xiaomi Inc., and the plaintiff has not provided written contracts with the transfer signings of Xiaomi HK Ltd. Representatives of NIS also noted that the goods were purchased from a company from the US, which in turn purchased it from the official distributor of Xiaomi.

In September, the sources reported that lawyer Alexander Shevchenko, acting on behalf of Xiaomi HK Ltd, represents the interests of the Allo group of companies, which includes Digitalech, the only official partner of Xiaomi in Ukraine. Actually, NIS buys a part of the Chinese company's products from the distributor. The remaining devices, according to Allo's representatives, are not intended for international markets.

NIS sells gadgets Xiaomi through its online store Xiaomi.ua/Mi.ua, as well as a chain of monobrand stores that develops in parallel with the brand retail.
