Nintendo is not going to let the large-scale Pokemon data breach that occurred in October 2024 go unchallenged and is taking decisive steps to identify the culprit. The company has filed a lawsuit in California to issue a subpoena to Discord, which, if approved, will require the platform to reveal the identity of Teraleak, the nickname Pokemon fans gave to the person behind the massive data breach.

Here's What We Know

According to reports, Teraleak released not only information about upcoming projects of Game Freak and The Pokemon Company, such as Pokemon Legends: Z-A, but also the personal data of Game Freak employees. The leaked files also contained data from previous Pokemon games, including concept art and cancelled designs. It's worth noting that Nintendo owns approximately 33 per cent of Pokemon, while Game Freak and The Pokemon Company own the remaining two-thirds.

Polygon has obtained a copy of Nintendo's court filing, in which the company demands the name, address, phone number, and email address of the attacker. Nintendo also provided redacted images from a Discord server called FreakLeak, where "Teralik", who used the nickname GameFreakOUT, posted 1 terabyte of information stolen from Game Freak's internal servers. One of the images provided by Nintendo shows GameFreakOUT posting a file with the leaked data and a message to members of the "Enjoy" group.

Nintendo has already attempted to remove the stolen data by sending DMCA takedown notices, but it still remains available online. Although the company has not yet announced its intention to file a lawsuit against Terroriker, Nintendo has a history of prosecuting those whose actions it considers a threat to its business.

For example, Gary Bowser was arrested on federal fraud charges for his involvement in the creation and sale of hacking tools for game consoles, including the Nintendo Switch, which allowed people to play games for free. Bowser has been released from prison but owes Nintendo $10 million in compensation, and 25 per cent of his monthly income is being withheld to pay this amount.
