Nintendo loses trademark battle against Super Mario supermarket

"Super Mario, a small supermarket in San Ramon, Costa Rica, has successfully defended its right to the name after Nintendo challenged the trademark. The store, run by Don José Mario Alfaro González, has been using the name for decades, combining the term "super" with the owner's name.
Here's What We Know
In 2013, the owner's son, Carlos Alfaro, decided to officially register the Super Mario brand, but when he tried to extend the term of this trademark recently, he was challenged by Nintendo, which referred to its global rights to the brand in various categories, including video games, clothing and toys.
It is worth noting that Nintendo did not register the trademark in the supermarket category in Costa Rica, which led to the National Registry, the country's trademark authority, ruling in favour of the local supermarket. The owner thanked his legal counsel, José Edgardo Jimenez Blanco , for his persistence and steadfastness during the litigation and admitted that it was very difficult to stand up to such a giant.
The supermarket's logo is a simple yellow and blue design with the slogan "Super Mario - Su lugar de confianza", which translates to "Super Mario - your safe place".
